Report: Fantasia Could Face Lawsuit For Being A “Home Wrecker”
Posted on August 12, 2010 at 2:52 PM

Oh. My. Goodness. It looks like Fantasia’s troubles may not be over, despite her release from the hospital. Her attorney, Gena Graham Morris, tells People that under North Carolina law, the ‘American Idol’ alum could be sued as a “home wrecker.”
Morris says Barrino has been named as a witness in the Cooks’s domestic case, in connection with the wife’s claim for spousal support, but “has not yet been sued for alienation of affection or criminal conversation.
“The people who think these claims protect marriages and families have never sat through a trial,” says Morris. “They make hurt people more hurt. For the sake of everybody involved,” adds Morris, “I hope [Fantasia] is not sued because she did not break up the Cooks’ marriage.”
Fantasia’s manager acknowledges that the singer had been dating Antwaun Cook “off and on” for the past eleven months but says Fantasia believed the couple had already separated.
I’m sorry. If Antwaun was indeed cheating on his wife with Fantasia, why isn’t Antwaun the one who is considered responsible for breaking up his marriage? We don’t know what he told Fantasia, but surely he knew the state of his marriage at the time.
What do you think of the whole idea that someone who has an affair with a married person can be sued as a “home wrecker”?

The married person should be able to think for himself.
Good new!
Maybe the Cook’s planned this whole circus on purpose to get some cash and attention. It wouldn’t the first time it has happened with the so called celebrities.
So far the wife has not chosen to sue, but she can do so in the state of North Carolina. I’m sure everyone agrees that he is responsible since he was the one married and probably lied whether saying he was separated or already divorced. Who knows. But Fantasia should have been smarter about it when there were all of the rumors about him still being married. Scandal can affect a celebrities livelihood so it would seem she would want to make sure he was legally divorced before she went on lavish trips with him and got his name tattooed on her shoulder (IMO she shouldn’t have gotten that at all).

WRONG legally when it goes to who is the “responsible party” as you say, for the cheating! You confuse the issue because, as you say, Antwaun is the one who has the obligation/contract with his wife, and therefore Fantasia is some sort of innocent third party. WRONG!!!
If you’re married, IT IS ILLEGAL and ADULTERY to have sex with someone other than your spouse, AND if you’re NOT married, IT IS ILLEGAL and ADULTERY to sex with SOMEONE ELSE’S SPOUSE!!!
Don’t like it and think it’s inappropriate for our time? Change the law.
You can’t be serious..it’s ridiculous to say that she should have had him investigated. What a sad state of affairs when you can’t trust ppl at their word and have to have them investigated. Who would want to invest that much time or money to investigate every person they date?? Get real! Anywho, ultimately Antwaun is the responsible party for cheating. He is the one who has an obligation/contract with his wife, not Fantasia. Put the blame where it belongs!

We must not live in the same country, because here in America, we certainly don’t have the law.
The problem here is that the cheated often blame the other person rather than their spouse, because it hurts less. It’s easier to say that the other person “stole” your bf/gf/husband/wife/whatever than to admit that your loved one has 0 respect for you.
Although she exhibited terrible judgement, Fantasia is not responsible. She didn’t force Antwaun to unzip his pants and pull it out. She didn’t force Antwaun to see her when he knew he had a wife at home. For God’s sake, the man has a functioning brain…you can make all the excuses you want but he still made a conscious decision to see Fantasia.
And because HE made both a promise in front of God and a legal contract with his wife, HE is responsible. Fantasia owes nothing and no loyalty to a person who is virtually a stranger to her.
This woman has enough resources to have had him investigated. There are ways to find out if a person is legally married or legally separated. In this case do even mess with that. Until the person has divorce papers in hand, it is not worth it. Fantasia should have known better. Shame on her for adding extra stress and aggravation to an already strained situation and dragging her own family through such drama. For God sakes her child will have to hear about this garbage. Shame, shame…..
I firmly believe that it takes two to cheat, but maybe if more spouses sued the men/women who cheat with their spouses, people would be too nervous to cheat.
It’s not so hard to DIVORCE and THEN find someone new. Ugh.
I am totally against cheating and all for live the other person if you wanna screw around, but pliiizze?? getting sued for being a “home wrecker”??? What a lot of crap…that woman is pathetic.
live=leave
I so wish that law was in affect in Maine when I divorced my husband. He had a number of gay affairs and infected me with a few STD’s. Now free and clear of the STD’s and happily married.
The person to put the blame on is the husband. He is the one who walked out the door and found someone else. Put the blame where it belongs. I bet if there wasn’t a celebrity involved there wouldn’t be a law suit. Someone is smelling easy cash.
