Are Katie Holmes & Tom Cruise Going To Have A “Messy” Divorce?

I think we’re all still reeling from the shock of Katie Holmes’ abrupt decision to file for divorce from Tom Cruise after five years of marriage. And if these news reports are any indication, then brace yourself: this looks like it’s gearing up to be a messy divorce. The prenup keeps Katie and Tom from arguing over financial matters in terms of spousal support, but where they get divorced and a custody dispute could keep this from being a clean split.
TMZ reports that, ultimately, the main issue for Katie is parenting differences. Katie apparently has never fully accepted Scientology and doesn’t want Suri raised as one. That’s why Katie has filed for sole custody of Suri: so Tom can’t make religious decisions for her. And apparently six is when Scientology starts to become a much larger part of a child’s life.
This is also why where the divorce occurs is so important. New York is more likely to award one parent sole custody if the parents can’t decide on childrearing practices, while California is more likely to insist on joint legal custody. To make matters worse, Tom has been trying to avoid calling New York his primary residence because the taxes are so high there. Yet he deeded their New York apartment to Katie via a trust that was set up for her, which is what Katie is citing as their primary residence. So there could be a fight over where the divorce is even conducted.
