“…Team Cruise is going to assert that Katie doesn’t meet the residency requirements to file in New York, and that both live full time in California, specifically Los Angeles. At the same time, Tom will file for divorce in California, and will most request joint custody of Suri. There is absolutely no way that he is going let Katie have sole custody. The lines are being drawn, and this is going shape up to be a very contentious custody battle.
“[Tom's lawyers] will state in their response to Katie’s divorce petition in New York that she didn’t reside continuously in New York for a year, as the law states. Yes, they do have a home in New York, but Tom will argue that Los Angeles is where they live, period.”
Tom may win this battle. New York’s residency law is that the couple be residing in New York at the time of the divorce and that they’ve resided there for one continuous year preceding the divorce. I know we’ve seen a lot of Katie and Suri in New York, but they’ve been in LA, too. They own properties in both states, so this will be battle #1. Katie’s lucky her father is an attorney!
The first news of Tom Cruise’s response to Katie Holmes’ bombshell divorce filing are in. He’s going to try to move the divorce to California rather than let it remain in New York, which is where Katie filed. His rationale is that they are California residents. A source tells Radar Online:
